1. DEFINITIONS
In this Terms of Service ("Agreement"), "we," "our," and "Excelsior Auto Detailing" refer to Excelsior Auto Detailing and its affiliates, employees, and agents. "You" or "Customer" refers to the individual or entity booking and/or receiving services from Excelsior Auto Detailing.
2. SCOPE OF SERVICES
Excelsior Auto Detailing provides professional automotive detailing services, including but not limited to interior and exterior cleaning, paint correction, ceramic coatings, and related offerings. All services are subject to availability and may require an appointment. Additional terms may apply to specialty services and fleet or dealership agreements.
3. APPOINTMENTS AND DEPOSITS
A non-refundable deposit may be required to secure your appointment. This deposit will be credited toward the final cost of services rendered.
4. CANCELLATION POLICY
If you wish to cancel or reschedule your appointment, you must provide a minimum of 48 hours’ notice prior to the scheduled time. Cancellations made with at least 48 hours’ notice are eligible for a refund of the deposit. Cancellations received with less than 48 hours' notice will result in forfeiture of the deposit, except in exceptional circumstances as determined solely by Excelsior Auto Detailing.
5. NO-SHOW POLICY
A “no-show” is defined as failing to appear for a scheduled appointment without providing any notice.
- First Occurrence: The deposit will be retained but issued as a store credit or gift card, redeemable for future services.
- Subsequent Occurrences: The deposit will be forfeited in full and no credit or refund will be provided.
Repeated no-shows may result in the refusal of future service.
6. PERSONAL ITEMS
Customers must remove all personal items from their vehicles prior to service. While reasonable care will be taken, Excelsior Auto Detailing is not liable for loss or damage to personal items left in the vehicle.
7. LIABILITY & VEHICLE CONDITION
Customers acknowledge and agree to the following:
- Any damage identified prior to service is deemed pre-existing and Excelsior Auto Detailing will not be held responsible.
- Excelsior Auto Detailing shall not be liable for damage or malfunction of electrical or mechanical components, particularly in engine detailing, despite all reasonable precautions.
- In the event of damage attributable to Excelsior Auto Detailing, we reserve the right to select the vendor or repair method.
Upon completion of services and delivery of the vehicle, the Customer accepts the work as complete and satisfactory, unless objections are raised immediately upon pickup.
8. PAYMENT TERMS
Payment is due in full upon completion of services, unless a written agreement has been made in advance. Accepted payment methods include cash, major credit cards, and e-transfers.
9. FLEET & DEALERSHIP VEHICLES
Dealerships and fleet customers agree that:
- Vehicles will be inspected at the time of pickup.
- Once vehicles leave Excelsior Auto Detailing premises, we are not liable for any subsequent claims of damage.
- The authorized representative assumes full responsibility post-pickup.
10. WARRANTIES & DISCLAIMERS
Excelsior Auto Detailing does not offer warranties beyond what is explicitly stated for specific services (e.g., ceramic coating durability, where applicable). All services are performed "as is."
11. LIMITATION OF LIABILITY
To the fullest extent permitted by Ontario law, Excelsior Auto Detailing shall not be liable for indirect, incidental, or consequential damages arising from services rendered.
12. GOVERNING LAW
This Agreement shall be governed and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
13. AMENDMENTS
We reserve the right to amend these Terms of Service at any time. Updated terms will be posted at https://www.excelsiordetailing.ca/terms-of-service and will take effect immediately upon posting.
14. VEHICLE OWNERSHIP AND MECHANIC’S LIEN
By presenting a vehicle for service, you represent and warrant that you are the registered owner of the vehicle or are fully authorized by the owner to request and approve services on their behalf. Excelsior Auto Detailing reserves the right to verify ownership or authorization at its sole discretion.
In accordance with the Ontario Repair and Storage Liens Act, Excelsior Auto Detailing reserves the right to retain possession of any vehicle on which work has been performed until full payment has been received. This right constitutes a legal mechanic’s lien. If payment is not made, Excelsior Auto Detailing may enforce this lien, which may include selling the vehicle after the appropriate legal process, in order to recover unpaid amounts.
